Afecta a Vinted, Wallapop, eBay y a muchas otras.
Qué datos envía Vinted a Hacienda
Preguntas frecuentes
Vinted reports your sales to the Spanish tax agency (Hacienda) if in one year you make 30 sales or more or receive more than €2,000. This is the European DAC7 rule, in force in Spain since the 2023 tax year. Vinted reporting you doesn't mean you have to pay tax: that depends on whether you make a profit and whether you sell as a private individual or as a business.
What DAC7 is
It's a European directive that requires digital platforms to report sellers who exceed certain thresholds to the tax authorities. It affects Vinted, Wallapop, eBay and many others. In Spain, platforms file it using modelo 238, in January of the following year.
When Vinted reports you
Meeting one of these two conditions in a year is enough:
- 30 sales or more, whatever the amount.
- More than €2,000 received, whatever the number of sales.
If you make fewer than 30 sales and don't go over €2,000, the platform doesn't report you. The thresholds are counted separately on each platform.
What data Vinted sends to the tax agency
- Name or company name, NIF or NIE, address and country of residence.
- Number of sales and total amount received.
- Fees the platform has charged you.
- The account in which you receive payments.
Do I have to pay tax on selling on Vinted?
DAC7 doesn't create any tax: it's just information. What you pay depends on the usual rules.
If you sell your used clothes
Selling your own things for less than they cost you doesn't normally produce a gain. Even so, keep some proof of the original price if you sell expensive items.
If you buy to resell
It's an economic activity: it's taxed under personal income tax (IRPF) or corporation tax and has its own VAT obligations. On Vinted, you also have to sell as a professional: we explain it in selling on Vinted as a professional.
What you should do
- Keep the receipts for what you buy to resell.
- Separate your personal sales from your business sales.
- If you resell for a living, register as a professional.
- Review what you sell on each platform: the thresholds count separately.
- If in doubt, ask your accountant (gestor).
Do you sell on several platforms? See how to sell on Wallapop and Vinted at the same time without losing control.
Practical examples
- 25 sales and €600 in the year: you don't reach either threshold. Vinted doesn't report you.
- 40 sales and €500 in the year: you go over 30 sales. Vinted reports you, even if you earn little or nothing.
- 10 sales and €2,500 in the year: you go over €2,000. Vinted reports you.
- 25 sales on Vinted and 25 on Wallapop: each platform counts separately, so neither reports you based on number of sales.
What happens if the tax agency asks you for an explanation
A platform passing on information doesn't mean the tax agency is going to claim anything from you. If it asks for clarification, what you need is to be able to show what you sold and how much you paid for it. That's why keeping supporting documents is so useful.
Which documents to keep
- Receipts or purchase invoices for what you sell, especially expensive items.
- The sales history the platform gives you.
- If you resell, supplier invoices and your own sales invoices.
Private sellers who sell a lot: the grey area
Some people sell a lot without being a business, for example when clearing out an entire wardrobe. What counts isn't the number of sales, but whether you buy to resell and whether you do it regularly. If you're unsure which side you're on, get advice before the year ends.
Frequently asked questions
Does Vinted report all my sales to the tax agency?
No. Only if in one year you make 30 sales or more or receive more than €2,000.
When does Vinted send the data?
In January of the following year, using modelo 238.
Do I have to declare what I sell on Vinted?
If you sell your used clothes without making money, there's normally no gain to declare. If you buy to resell, it is an economic activity. Check your situation with an accountant.
Is DAC7 a new tax?
No. It's a reporting obligation for platforms.
